The motion picture Miami Beach Cops is the property of "A JOINT FILM VENTURE COMPANY", a company owned by James B. Winburn. Peacock Films and Distribution Company, at 3439 Chauenga Blvd, Los Angeles, CA 90068, released the film "Miami Beach Cops" in 1993 after "Peacock Film" changed the name from "Osceola 3351 to Miami Beach Cops." Peacock Films sold "Miami Beach Cops" to many foreign film markets around the world between 1993 to 1996 up unto this date. I have not seen any market sales sheets or receipts from any of those film markets that "Miami Beach Cops" was sold to. From the time, Allan R. Penny the executive producer, signed an agreement to screen the "Osceola 3351" video trailer at the Los Angeles Film Market in Santa Monica, California, in 1993, agreeing that after the close of the Los Angeles Film Market, Jim Winburn and Moshe Bibiyan would setup a date for a meeting at his Los Angeles office. I got back into Los Angeles two weeks after the Los Angeles Film Markets closed. I began another film project. I flew in to Los Angeles to check on my home in Toluca Lake and to see Moshe Bibiyan with a complete edited film master on a "1" inch master studio tape to complete the distribution agreement on "Oscoela 3351". I called Moshe Bibiyan at his Peacock Films office at (818) 874-6000 many times in an effort to get a date and time for a meeting at his office, and to go through the distribution agreement and send the agreement by fax to my attorney in Orlando Florida with all corrections about the market sales and revenues information before leaving for location in Atlanta Georgia. Moshe never returned my calls. I drove to his office at 3439 Chauenga Blvd., Los Angeles, Ca., 90068, and I could not get in or past the reception desk up stairs to see Moshe Bibiyan. From 1993 to late 1996, I traveled to most of the film market expo's in Europe to have a conversation with Moshe Bibiyan. I dropped in on his booth or suite to engage in a conversation with Moshe Bibiyans about the distribution agreement and the market sales he was closing with the market buyers at the various film market expo's. Not once did I ever receive an honest answer to any of my questions from Moshe Bibiyan or Simon Bibiyan on the number of markets the film was sold in. By the time the distribution agreement was signed, all the major markets were sold, and the value of the film "Miami Beach Cops" was destroyed. For three years, I have received no answers to any of my questions, no financial reports on market sales, and I have not received any official letters from the Peacock Films company stating that Peacock Films is changing ownership, nor who is doing the accountability of distribution and auditing of the sales or keeping recorders of the "Miami Beach Cops" sells. My Attorney in Orlando communicated many times with Peacock Films from 1993 to 1996. Between my attorney and Peacock Films, no information was given to me about anything regarding "Miami Beach Cops." There after, the Orlando attorney resigned from representing me (James B. Winburn) as my company entertainment attorney. A Joint Film Venture Company corporation was a registered corporation in the State of Florida at the time the film was in production, 1993. Allen R. Penny, the executive producer, and James B. Winburn producer/ director and owner of A joint Film Venture Company for the "Oscoela 3351". The attorney in Orlando Florida never received any net returns information from the gross sales of the film from Peacock Films marketing sales accounting department on "Miami Beach Cops" the film. In one of the only conversations with Moshe Bibiyan in his office, he wanted to change the name of "Oscoela 3351" to "Miami Beach Cops". After a long conversation, I said to Moshe, "I would fly back to Orlando and re-edit the name of the film to 'Miami Beach Cops' if the film revenue would increase." Moshe said, "It's a better name to the foreign market buyers and the profit should do well." I flew back to Orlando and re-edited the film name to "Miami Beach Cops". But little that I knew, Peacock Films already re-edited the film name and was selling it in the foreign markets. In 1995, I went to the Peacock Films corporate office, after trying to be professional about getting together and having a conversation on my film. I made many telephone calls to Peacock Films to have a meeting and sit down in his office and discuss the subjects: net profit returns, which were none. Plus, no quarterly marketing statements, as the agreement stated, and a complete audit statement on producer net profit after the distribution gross receipts, were in. So after all conversations broke down and no answers were given except that the film did poorly, I asked Moshe to get me a copy of all the film sales and what markets the film "Miami Beach Cops" were sold at. Moshe said no one will see his book records on any film without a court order. I told him, "I would bring in my accountant Marvin Alpert to check over "Miami Beach Cops" accounting records only. I didn't care to see any other film market sales records." That didn't fly with Moshe. So, the next step was to tell Moshe Bibiyan, President of Peacock Films, to stop distribution on "Miami Beach Cops" and give me back all my master tapes. Plus, I wanted a complete audit of the marketing sales for three years, 1993 to 1996. After a long unpleasant conversation with staff members and Moshe Bibiyan at Peacock Films office. I finally got back my master beta SP Digital tape of "Miami Beach Cops" and original "1" inch master of "Osceola 3351". I also asked for all the beta SP master tapes and all the VHS copies tapes of "Miami Beach Cops" back from Peacock Films with in 30 days. Moshe Bibiyan the president of Peacock Films, gave me his word. He assured me that his attorney would write me the letter of a "discontinue of distribution sales" on "Miami Beach Cops" and all rights of the films would refer back to A JOINT FILM VENTURE COMPANY, James B. Winburn owner. I have not received the letter to this date, or any letters of "discontinue of distribution sales" on "Miami Beach Cops" or the letter stating that all rights would refer back to James B. Winburn. In that same year, 1996, many of the independent film producers that had agreements with Peacock Films to do distribution for their film never received any market sales reports or any money from the sales of their films. These producers protested at the Los Angeles Hall of Justice Building in downtown Los Angeles. It made all the major television news channels. Peacock Films claim they were going to file a lawsuit on those producers that protested. With in months, Peacock Films changed hands again. This time with First Miracle Pictures. I stopped by the Peacock Film office the day that the Peacock Films and First Miracle Pictures became one company. I asked Moshe the same questions. "Where is the legal document of the discontinue of distribution sales on "Miami Beach Cops" and all rights of the film "Miami Beach Cops" referring back to James B. Winburn, A Joint Film Venture Company owner?" From that day, Moshe went underground. 1st Miracle Pictures/ Peacock Films has gone through many changes under the control of Menahem Golan and Moshe Bibiyan. 1st Miracle Pictures/ Peacock Films continue selling "Miami Beach Cops" worldwide and to companies on the Internet. Now that many years have gone by with many discussions with various entertainment attorneys to communicate with Peacock Films or find information on what company or companies, who are in charge of the Peacock Films library, the attorneys could never get a working telephone or address for any company that has control of Peacock Films records. U.S. laws on distribution do not stop distribution companies like Peacock Films or companies or other companies to sell any producer's films making money on illegal sales of their films on the Internet.
